Listing Fee

Commission for the Buyer’s Agent is not included in the 1% assigned Real Estate Agent Listing Fee. Sellers typically offer 2.5% to 3% commission to Buyer’s agents to encourage these agents to show the seller’s property to prospective buyers. This commission is in addition to the realtor’s Listing fee.

Buyer’s Refund

Assigned Real Estate Brokerage will rebate the buyer up to 1% of the final purchase price of the home, subject to receipt of Cooperating Buyer Broker Commission from the Listing Broker. The final refund amount will vary based on the final purchase price and commission rate offered by the seller (typically 2.5% to 3%). New construction properties that do not require showings may be eligible for a refund amount higher than 1%.

To be eligible for the Refund, the buyer must use GenVaeh Realty’s preferred Real Estate Brokerage. If the transaction does not close or if we do not receive compensation, no Buyer Refund will be due. The Refund is subject to a minimum net commission of $5,000 to preferred Real Estate brokage after taking into account the Buyer Refund. Any MLS or Listing Broker fees or charges passed on to the Brokerage as the Buyer Broker will be deducted from the gross commission before calculating the Buyer Rebate.

The actual value of the Refund may be calculated on a tiered basis determined by the number of home showings that you schedule through preferred Real Estate Brokage—either via our website, mobile app, or by contacting one of our preferred agents directly. After the first ten showings, the rebate will decrease to 0.5% of the final purchase price. Lender approval may be required. Some lenders may not allow a Buyer Rebate, or depending on the contract, concessions, mortgage product, and financing terms, some lenders may not allow the Buyer to receive the full refund from the preferred brokerage. We strongly advise buyers to talk with their lender in advance about their anticipated Buyer’s Refund.

GenVaeh Realty Terms & Conditions of Use

Effective 11/20/2023 Read this Terms of Use Agreement (these “Terms”) carefully before utilizing www.genvaehrealty.com (the “Website”) or the GenVaeh Realty mobile app (the “App”) (the Website and the App may be collectively referred to as the “Software”). Your engagement with the services and tools available on or provided through the Website and the App or through any employees or representatives of GenVaeh Realty (collectively, the “Services”) is contingent upon these terms and conditions (these “Terms” or this “Agreement”). By accessing the Website, downloading and using the App, or using the GenVaeh Realty text alerts or any of the Services, you signify acceptance of these Terms and enter into a legally-binding contract between you, the end user (hereinafter “You” or “User”), and GenVaeh Realty, Inc., a Florida Limited Liability company, and its subsidiaries (“GenVaeh Realty”). If you engage with the Software as both a Seller and a Buyer, the respective statements apply to your distinct interactions.

If you do not agree to these Terms, promptly cease the use of the Software and uninstall it from your mobile device. Your acceptance of these Terms also includes your agreement to the terms of our Privacy Policy, which is incorporated by reference into this Agreement and is thus an integral part of this Agreement. GenVaeh Realty may modify these Terms at any time without prior notice to you by posting a new version. The new version will become effective on the date it is posted, indicated at the top of the Terms as the Effective Date. It is your responsibility to periodically review these Terms and the Privacy Policy. Your continued use of the Software after the Effective Date constitutes acceptance of the new Terms. If you disagree with the revised Terms, you must immediately discontinue the use of the Software and uninstall the App from your mobile device.

General Provisions

  1. Submission and Administration of Listing
    • Content: You may submit property descriptions, photographs, images, videos, graphics, virtual tours, or other supported media or copy, and other information to GenVaeh Realty (collectively, the “Content”) for each Property advertisement you create using the Services. GenVaeh Realty may also engage third-party vendors to produce Content for your advertisements.
    • Ownership: You retain any applicable ownership rights that you may have with respect to the content you submit. However, you grant GenVaeh Realty, its affiliates, and their licensees a royalty-free license to use, display, and publish such Content (in whole or in part).
    • Use and Ownership of Transaction Data: You agree that any data submitted or processed through the Services will be captured, stored, and will become the sole property of GenVaeh Realty.
  2. User Communication
    • Email and Text Permissions: GenVaeh Realty uses email and SMS text as its primary communication channel with Users. As a registered User, you hereby acknowledge and grant GenVaeh Realty permission to communicate with you via email (as well as other communication channels such as mobile phone and text message) for any purposes GenVaeh Realty determines to be relevant.
    • Responsibility for Protection of Property and Self: GenVaeh Realty provides communication tools that allow Users to interact with each other and schedule in-person tours of Properties listed on GenVaeh Realty. YOU ALONE ARE RESPONSIBLE FOR YOUR SAFETY AND THE PROTECTION OF YOUR PROPERTY WHEN INTERACTING WITH OTHER USERS.
  3. Use of Information
    • Disclaimers: You agree to treat all related-property sales’ price information obtained from the Services as GenVaeh Realty’s sole property. You may not resell or otherwise use such Value Reports other than pursuant to the Terms of this Agreement. GenVaeh Realty does not guarantee the accuracy of, endorse, or recommend any information provided through the Services.
  4. Limitation of Liability and Indemnification
    • Limitation of Liability: GENVAEH REALTY IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR OTHER INTANGIBLE LOSS. Your exclusive remedy, and GenVaeh Realty’s entire liability under this Agreement, shall be a refund of the fees paid to GenVaeh Realty hereunder.
    • Indemnification: You agree to indemnify GenVaeh Realty and hold it harmless from and against any and all costs, damages, or losses arising from your use of the Software or Services.
  5. Intellectual Property
    • The content provided in the GenVaeh Realty Software is protected by law. GenVaeh Realty is the exclusive owner of or is the licensed user of all designs, text, graphics, images, video, information, logos, button icons, software, audio files, and other content on the Software.
  6. Governing Law; Jurisdiction and Arbitration
    • Except for actions to protect intellectual property rights, all disputes will be submitted and finally resolved by arbitration under the rules of the American Arbitration Association. The arbitration will take place in Orlando, Florida, USA.
  7. Assignment
    • This Agreement shall be binding upon and shall inure to the benefit of the parties and their respective successors and permitted assigns.
  8. Waiver, Severability, and Survival
    • The failure of GenVaeh Realty to exercise or enforce a legal right or remedy contained in this Agreement does not constitute a waiver of any such right or remedy. If a court finds any provision of the Terms and Conditions to be invalid, the User agrees to continue to abide by such provision, and the remaining terms and provisions will remain in full force and effect.
  9. Notices
    • All notices to GenVaeh Realty must be in writing and must be sent via registered mail, certified mail, or overnight mail with a return receipt requested to GenVaeh Realty offices in Lake Mary.
  10. Entire Agreement
  • This Agreement constitutes the entire agreement between the parties and supersedes all previous agreements and understandings, whether oral or written, with respect to the subject matter of this Agreement. No representative of GenVaeh Realty may make oral modifications or amendments to this Agreement. Only written modifications signed by an appropriate executive of GenVaeh Realty will be valid.

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Embedded content from other websites

Who we share your data with

If you request a password reset, your IP address will be included in the reset email.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us.
